Terms of Use

These Terms of Service ("Terms") govern your access to and use of the products, services, websites, and mobile applications offered by SalonHome, Inc., a Georgia corporation operating as Salonhome and www.salonhome.com ("Salonhome," "we," "us," or "our"), including our online and in-app tools for discovering and booking beauty and wellness services and for listing and renting salon workspace (together, the "Platform").
Please read these Terms carefully. By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. What Salonhome is
Salonhome is a marketplace and technology platform that connects independent participants. We do two things:
Service and Class bookings. We let clients ("Clients") discover and book independent beauty and wellness professionals ("Providers") for services or classes such as hair, barbering, nails, massage, and makeup, performed at a location the provider offers or at a Client's chosen location.
Workspace rentals. We let owners and operators of salon space ("Hosts") list salon suites, rooms, booths, and stations, and let independent professionals ("Renters") find and arrange to rent that space.
A single user may act in more than one role. The general terms apply to everyone; role-specific sections apply as noted.
2. What Salonhome is not
Salonhome is a neutral venue and technology provider. We are not a salon, a beauty or wellness services business, a landlord, a lessor, or a property manager, and we do not own, operate, control, maintain, or supervise any salon, suite, premises, or service.
We are not a party to any agreement formed through the Platform. The contract for a service is solely between the Client and the Provider. The contract to rent space is solely between the Host and the Renter. Salonhome does not perform, direct, or guarantee any service, and does not own, inspect, or warrant any space.
Providers, Hosts, and Renters are independent contractors and independent businesses. Nothing in these Terms creates an employment, agency, partnership, joint-venture, or landlord-tenant relationship between Salonhome and any user. They control how, when, where, and whether they offer services or space, set their own prices and terms, supply their own tools, products, and premises, and are responsible for their own taxes, licenses, insurance, and operations.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Platform. To access most features you must register and provide accurate, current, and complete information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@salonhome.com of any unauthorized use.
We may refuse, suspend, or terminate any account at our discretion, including for violation of these Terms, the Code of Conduct, the Health and Safety Standards, or applicable law.
4. Provider terms
If you offer services as a Provider, the following apply in addition to the general terms.
Licensing and authority. You represent and warrant that you hold and will maintain all licenses, registrations, certifications, and permits required to lawfully perform your services in each jurisdiction where you accept bookings, including any massage-therapy or other specialized credential, and that you will perform services in compliance with all applicable laws and the Health and Safety Standards.
Independent business. You determine your own services, availability, service area, and pricing within the Platform's parameters, supply your own equipment, tools, and products, and are solely responsible for your federal, state, and local taxes. Salonhome does not withhold taxes on your behalf.
Insurance. You are responsible for maintaining the insurance described in the Health and Safety Standards, including professional and general liability coverage where required.
Accurate representations. You will keep your profile, credentials, and service descriptions truthful and current.
Fees. Salonhome charges service fees as disclosed in your dashboard and at booking. We may change fees prospectively on notice.
5. Client terms
If you book or receive services as a Client, the following apply in addition to the general terms.
You agree to provide accurate booking information, to be present or make suitable arrangements for the appointment, and to disclose relevant health information, allergies, sensitivities, and contraindications to your Provider before service. For services at your home or chosen location, you agree to provide a safe, lawful, and reasonably suitable environment. You agree to treat Providers, Hosts, Renters, and other users with respect and consistent with the Platform's anti-harassment and anti-discrimination expectations.
6. Workspace rental terms
This Section applies to Hosts who list space and Renters who arrange to rent it.
Salonhome's role. Salonhome provides the marketplace where Hosts and Renters find one another. The rental itself is a direct arrangement between the Host and the Renter. Salonhome is not the landlord, lessor, sublessor, agent, or property manager, is not a party to the rental or license agreement, and does not guarantee any space, its condition, legality, safety, suitability, or availability.
Host obligations. If you list space, you represent and warrant that you have the legal right and authority to offer it for rent; that the space and its intended use comply with applicable zoning, licensing, building, fire, health, and safety laws; that your listing is accurate as to location, amenities, condition, price, and availability; and that you will enter a direct written rental or license agreement with the Renter setting the binding terms of occupancy. You are solely responsible for the premises, including its condition, maintenance, security, any video surveillance you operate, and compliance with applicable landlord-tenant or licensing law, and for your own taxes and insurance.
Renter obligations. If you rent space, you are responsible for conducting your own due diligence on the space and the Host, for holding all licenses required to perform your services there, for complying with the rental agreement, the Host's rules, the Health and Safety Standards, and applicable law, and for maintaining appropriate insurance.
Disputes between Hosts and Renters. Rental disputes are between the Host and the Renter. Salonhome may provide limited support but is not responsible for resolving them and is not liable for the acts or omissions of any Host or Renter.
7. Bookings, payments, and fees
Bookings are requests to engage a Provider and become confirmed as described on the Platform. Service prices are set by Providers and shown before you confirm. For in-app payments, our third-party processor, Stripe, LLC., handles the transaction, and Salonhome may collect its disclosed fee; for in-app Client bookings, Salonhome collects payment on the Provider's behalf as a limited payment collection agent.
Rent and rental fees are set between the Host and the Renter. Where the Platform facilitates rental payments, Stripe, LLC processes them and Salonhome may collect a disclosed fee. Applicable taxes are shown where collected.
You agree to use the Platform in good faith and not to misuse contact information obtained through it to spam, defraud, or harm other users.
8. Cancellations, refunds, and no-shows
Cancellation, rescheduling, refund, and no-show terms for services are described in our "Cancellation Policy", which is incorporated into these Terms. Providers may set cancellation windows within the parameters we allow. Rental cancellation and refund terms are set in the Host-Renter agreement. Salonhome is not responsible for refunds beyond what the applicable policy, agreement, and payment processor permit.
9. Reviews, ratings, and content
The Platform allows users to post reviews, ratings, photos, listings, and other content ("User Content"). You are responsible for your User Content and represent that you have the rights to post it and that it is accurate and not unlawful, defamatory, infringing, or deceptive.
You grant Salonhome a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, display, reproduce, and distribute your User Content in connection with operating and promoting the Platform. We may, but are not obligated to, moderate, screen, or remove User Content.
10. Acceptable use and prohibited conduct
You agree not to: violate any law or third-party right; provide false or misleading information, including inaccurate listings; impersonate any person; harass, threaten, discriminate against, or harm any user; misuse the Platform or another user's information; scrape, reverse engineer, or interfere with the Platform; introduce malware; or use the Platform for any service that is unlawful or that requires a credential the Provider or Renter does not hold, including services that require a medical license.
11. Intellectual property
The Platform and all associated software, designs, text, graphics, logos, and trademarks are owned by Salonhome or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Platform for its intended purpose. All rights not expressly granted are reserved.
12. Third-party services and spaces
The Platform may integrate or link to third-party services, including payment processors and mapping services, governed by their own terms. Spaces listed by Hosts are operated by those Hosts, not by Salonhome, and any rules, privacy practices, or surveillance at those spaces are the Host's responsibility.
13. Assumption of risk
Beauty and wellness services involve inherent risks, including allergic reactions, skin irritation, and injury. In-person services carry the added risks of receiving services on premises or, for in-home services, of allowing another person into a private space or entering a Client's premises. Renting and using space carries the ordinary risks of occupying premises you do not control. You acknowledge and voluntarily assume these risks. Any verification Salonhome chooses to perform does not constitute an endorsement or guarantee.
14. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SALONHOME DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PROVIDER, HOST, RENTER, OR CLIENT, OR ANY SERVICE BOOKED OR SPACE LISTED THROUGH THE PLATFORM, WILL MEET YOUR EXPECTATIONS. SALONHOME MAKES NO WARRANTY REGARDING THE CONDUCT, QUALIFICATIONS, SERVICES, OR SPACES OF ANY USER.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALONHOME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, ANY SERVICE BOOKED THROUGH IT, OR ANY SPACE LISTED OR RENTED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SALONHOME'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO SALONHOME IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify, defend, and hold harmless Salonhome and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your User Content or listings, your violation of these Terms or applicable law, or, for Providers, Hosts, and Renters, your services, your space, and your relationships with Clients, Hosts, or Renters.
17. Term and termination
These Terms remain in effect while you use the Platform. You may close your account at any time. We may suspend or terminate your access at any time as described in Section 3. Sections that by their nature should survive termination (including Sections 9, 11, and 13 through 19) survive.
18. Dispute resolution and arbitration
The following provision is a binding arbitration agreement with a class-action waiver. Confirm enforceability, the chosen arbitration provider, and the opt-out mechanism with counsel before publishing.
Most disputes can be resolved informally. Before filing a claim, you agree to contact us at support@salonhome.com and attempt a good-faith resolution for at least 30 days.
If unresolved, you and Salonhome agree that any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding arbitration administered under its rules, on an individual basis. YOU AND SALONHOME WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to support@salonhome.com or the mailing address below. Claims that qualify may be brought in small-claims court. This Section governs disputes with Salonhome only and does not reach disputes between users, such as between a Host and a Renter.
19. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Subject to Section 18, the state and federal courts located in Georgia will have exclusive jurisdiction over any matter not subject to arbitration.
20. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a revised effective date and, for material changes, provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
21. General
These Terms, together with the Privacy Policy, Health and Safety Standards, Code of Conduct, and any policies referenced here, are the entire agreement between you and Salonhome regarding the Platform. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
